CHAPTER I.
FOREWORD
For over 30 years of war and
suffering, the pain and outcry of the Cambodian people, the
Cambodian-Americans, the Cambodian-Canadians, and all the Cambodian-Overseas
alike would like to dedicate ourselves to fight for basic freedom and true
democracy for Cambodia as follows:
To build a nation with true
democracy with respect to the rule of law, basic human rights, and free of
foreign exploitation. We, the Cambodian-Americans, the
Cambodian-Canadians, and all the Cambodian-Overseas, take a solemn stance on
this day, November Fifteen, Nineteen Ninety Eight to hold a union of trust,
sincerity, and truth.
To
unite all the Cambodian-Americans, the Cambodian-Canadians, and all the
Cambodian-Overseas alike whose vision is for a better future for the
children of Cambodia and its beloved motherland.
To
strengthen the Sam Rainsy Party vision which stands for morality, truth and
justice, true democracy, self-determinism, and equality for the people.
CHAPTER
II.
NAME AND GENERAL
PURPOSE
SECT. 1.
DEFINITION
The Sam Rainsy Party USA/Canada (SRP-USA/Canada),
a non-profit organization, was formed by the Cambodian-American citizens
living in the U.S. and the Cambodian-Canadian citizens living in Canada,
which has the full-fledged political affiliation to the parent organization
of SRP-Cambodia. SRP-USA/Canada seeks a proactive role in conjunction with
SRP-Cambodia to implement a multi-sector reform of in the areas of judicial
system, civil servant, education, financial revenue and expenditure, land
and environment, and a whole host of other critical issue facing today’s
Cambodia. Nonetheless, the immediate and foremost goal of SRP-USA/Canada is
to promote a long-lasting relationship, and supporting role with SRP-Cambodia.
Any membership to SRP-USA/Canada would be subject to review by the SRP-USA/Canada
committee, Supreme Council, and Board of Directors.
CHAPTER III.
MISSION
SECT. 1. Seek to influence the United States, Canada,
Cambodian allies, and all the international community on matters of
political, diplomatic, and humanitarian issues relating to the development
of national security, sustainable economic development, and international
cooperation.
SECT. 2. Maintain and strengthen grassroots support for
State/Province Delegate and local SRP-chapter throughout the United States
and Canada. Respond to social or natural disaster situations occurring in
Cambodia.
SECT. 3. Keep local SRP-chapter well informed of current
political events that might endanger the safety of fellow SRP members,
victims of politically motivated offenses, and any human rights abuse that
may undermine peace and stability.
SECT. 4. Raise funds to adequately cover annual budget
expenditures by utilizing maximum resources, skills, and services from SRP
members to their full potential.
SECT. 5. Communicate and provide support to all local SRP-USA/Canada
and SRP-Cambodia for all the necessary skills, personnel, and financial
resources that will benefit the party as a whole.
SECT. 6. Restore and promote the spirit of democracy,
nationalist ideals, and self-determination among students, Buddhist
monasteries, community and local organizations longing for peace and
stability for Cambodia.
CHAPTER IV.
COMPOSITION
SECT. 1.
SRP-USA/CANADA
SUPREME STATE/PROVINCE
COUNCIL
ITEM 1.1. DEFINITION
1.1.1.
Membership to this independent body is reserved for the most
senior and widely respected individuals who have actively served or
supported SRP party, or any distinguished individuals that have made
significant contributions to the organization. Any appointments shall be
finalized by the agreement of the SRP-USA/Canada President, and any three
(3) members of the Executive Committee.
1.1.2. Membership of the Supreme State/Province Council
is honorary and ceremonial. Each member is regarded as a leading figure in
supporting the party platform and day-to-day affairs.
SECT. 2. SRP-USA/CANADA
State/Province Delegate
ITEM 2.1. DEFINITION
2.1.1. Each State/Province Delegate member may have
only one (1) vote and a minimum of five (5) votes shall apportioned for each
local SRP Chapter affiliate.
2.1.2 Membership to the State/Province Delegate is
reserved to those who displayed dedication, honesty, and significant
contributions to the SRP organization. Each membership to the
State/Province Delegate must be nominated and referred by the local SRP-Chapter
President.
ITEM 2.2. MEMBERSHIP RULE
2.2.1. Any State/Province Delegate members who fail to
pay membership fee to their local SRP Chapter affiliate for 30 days shall be
reminded by written notice, fax, and/or e-mail by the local SRP Chapter
Treasurer. The local SRP Chapter Treasurer shall advise State/Province
Delegate members of any default memberships as prescribed in items 2, 3, and
4.
2.2.2. Due to exceptional circumstances beyond their
control, any State/Province Delegate members that are in an extreme
financial hardship are entitled to waive membership obligation for up to
five (5) consecutive months. State/Province Delegate members must submit a
written and/or verbal explanation to the Treasurer stating the reason for
such action. Members who choose to ignore this obligation for 90 days shall
be in default for probation and shall be removed the right to vote in the
general election, but remain as SRP-USA/Canada regular member. In which
case, the member may continue his or her membership for another 60 days of
probation beyond when his or her membership shall be revoked pending
reauthorization by the Director of Membership.
2.2.3. Executive officers, committee directors, and
state/province-level representatives shall be held to a higher standard of
membership obligations inclusive of strict terms and limits, and sever
disciplinary penalties. They shall not be late more than 75 days of due
membership payment. Exceeding which time, the violation shall constitute
grounds subject to disciplinary actions by the President and/or the
Director, which may range from temporary functional suspension or revocation
of the right to vote, to permanent removal from office. In the event an
officer has been absent for more than the said period or the circumstances
could not prevail for he or she to maintain a good membership standing, the
President and/or the Director shall rule in light of the crucial
consequences of their actions on the subject violation as they see fit. The
President, executive member, or any Committee Director shall be vested with
the authorization to act independently should anyone of them involves in the
subject violation. A simple majority of executive member votes shall be
sufficient to impose disciplinary actions, should both the President and the
Committee Director concurrently become the subjects of 75-day late payment,
and the majority vote shall subsequently rule on appropriate actions that
range from dismissal, temporary functional suspension or revocation of the
right to vote, to permanent removal from office.
2.2.4. Any individual who is terminated from their
negligence and wrongdoings shall be eligible for reinstatement pending a
full review by the Director of Membership. The State/Province Delegate
members shall be required to submit a complete package of application along
with a written statement to the Director of Membership.
ITEM 2.3. OBLIGATION AND PRIVILEGE
2.3.1. Each State/Province Delegate members shall have
one vote in any election including presidential election.
2.3.2. State/Province Delegate members may serve or be
candidate in the Committees of the Executive Committee in any capacities.
2.3.3. State/Province Delegate members shall fulfill
all prescribed obligations or risk loosing privileges and ultimately,
membership.
SECT. 3.
SRP-USA/CANADA EXECUTIVE BRANCH
ITEM 3.1. PRESIDENT OF
SRP-USA
3.1.1. Objective Qualification for
Candidacy
Potential candidates wishing to be
considered for candidacy to the office
of the President of SRP-USA must
satisfy all of the following criteria:
3.1.1.2. Have a minimum of one (1) full year of
State/Province Delegate membership in good standing.
3.1.1.3. Successful completion as a minimum of any
two-year program of study from an accredited institution in the United
States or Canada that included a major field of study leading to any of the
following majors: natural science, social science, physical science,
business administration, management, criminal justice, computer science,
engineering, arts.
3.1.1.4. Candidate
must never have been involved in criminal activities that
violated
local, state and federal laws, except for minor traffic offenses and
misdemeanors.
3.1.1.5.
Having accumulated a minimum of two (2) consecutive years of
professional
experience beyond secondary school, preferably in Cambodian community
assistance projects, non-profit charitable activities, and non-governmental
community development efforts serving Cambodia, United States, and/or Canada
shall be adequate in lieu of the prescribed formal education. Other
equivalents may directly substitute the above qualification but not on a
prevailing basis. These include any experience gained while earning an
income from operating a privately owned small business, working for a
commercial or industrial outfit, serving a public entity such as
local/Federal Government or a combination thereof.
At the
request of the Elections Committee (EC), potential candidate shall submit
his/her resume outlining related skills and qualifications to include
references information to the EC.
3.1.2. Subjective Qualification for
Candidacy
While this category does not
establish a mandatory basis, preferred
considerations are given to
those who demonstrated to all, or any of the following attributes:
3.1.2.1. Person of high moral character, having
demonstrated honesty, integrity and accountability without discrimination to
social status, age, sex, disability, racial origin, religious belief, and
political affiliation.
3.1.2.2.
Possessing excellent communication and written skills in Khmer
and/or English.
3.1.2.3. Ability to motivate others in a stressful
situation while maintaining full composure and impartial view in resolving
existing conflicts or dispute among SRP members.
3.1.2.4. Complete
understanding of the SRP party's platform, bylaw, goals and
objectives,
and internal issues facing the Party.
3.1.2.5. Knowledge of Khmer history,
culture, and governments, particularly the
more recent socio-economic
and political developments and issues that related to them.
3.1.3. Tenure
3.1.3.1. By the power vested in the simple majority vote
of the State/Province Delegate , an outgoing President together with a
chosen member of the Supreme State/Province Council shall confer all
duties, privileges, and honors to the incoming President as the Chief
Executive Officer of the SRP-USA/Canada, and shall conduct all due affairs
on its behalf.
3.1.3.2. He/she is nominated and elected from among
State/Province Delegate members by simple majority vote for a two-year term.
3.1.3.3. He/she shall not serve or be connected in any way
with another organization of political or racial conflict with the SRP-USA/Canada
platform, other than his profession.
3.1.3.4. Should elections be held after the First of June,
the presidential term begins each calendar year on the First of January,
otherwise the President-elect shall assume office immediately after the
election. The incumbent continues to serve, during the period of transition
until December 31.
3.1.4. Responsibility
The President
of the SRP-USA/Canada is tasked with but not necessary limited to the
following responsibilities:
3.1.4.1. Presides over State/Province Delegate Annual
Meeting session as well as generates inputs for the meeting agenda.
3.1.4.2. The president is the Chief Enforcement Officer
such that his/her authority on matters of enforcement rules shall not be
undermined.
3.1.4.3. The President is obligated at all time, to act on
any State/Province Delegate approved resolution, final draft, and individual
recommendation in a timely manner.
3.1.4.4. The President is obligated to give consideration
to all requests when formally introduced by one or more SRP-USA/Canada
member, and may take the request to a full debate among SRP-USA/Canada
member.
3.1.4.5. The President shall formulate and presents
proposed working agenda or plan to the Executive Committee for evaluation
and execution.
3.1.4.6. He/she shall monitor the activities of the
Executive Committee to chart progress and draft new course of action.
3.1.4.7. He/she shall submit regular comprehensive reports
to the State/Province Delegate annual meeting on issues relating to new
development, change, irregularity, and prioritized course of action.
3.1.4.8. He/she shall communicate with individual
State/Province Delegate Executive Committee members on the status of the
organization to strengthen working relationship, receive feedback, and
keeping them advised of any critical issues. .
3.1.4.9. Candidates running for presidency may nominate
directorship candidates including two vice presidential running mates to any
posts on the Executive Committee. Such nominations would not prohibit
voluntary nomination (self-identified), or assisted nomination by
State/Province Delegate members or members of the Executive Branch. Should
any two nominations coincide, candidacy by virtue of presidential candidate
nomination shall prevail.
3.1.4.10.
The President shall establish and maintain good working relation with SRP-Cambodia.
ITEM 3.2.
VICE-PRESIDENTS
3.2.1. Tenure
3.2.1.1. Two (2) Vice-Presidents, First and Second Vice
Presidents are designated to the President on his/her nominations. These
nominations shall take place during which the Executive Committee
directorship candidates are nominated. Vice-presidential nominations may be
overturned on the unanimous dissent of the outgoing Executive Committee
members by means of secret ballots. The First and Second Vice Presidents, in
that order, shall assume all duties, privileges and honors in the absent of
presidential appointments, otherwise the President deems the order of his
substitution as appropriate during his/her absence.
3.2.2. Responsibility
3.2.2.1. Each Vice-President shares both the tasks and the
responsibilities of the President in addition to heading of a Committee.
Elected by State/Province Delegate simple majority vote, either
Vice-President may select a Committee of their preference and assume the
responsibilities thereof.
ITEM 3.3.
SECRETARY GENERAL
3.3.1. Tenure
3.3.1.1. Appointed by the President from among
State/Province Delegate members, a Secretary General serves for the duration
of a presidential term.
3.3.2. Responsibility
3.3.2.1. The Secretary-General shall work hand-in-hand
with the President, Executive Directors, and State/Province Delegate to
implement approved drafts, resolutions, and plans of actions. He/she shall
seek mutual cooperation among the SRP-members while preserving the rule of
Bylaw.
3.3.2.2. He/she shall lead the role as a watchdog for any
but not limited to shortfalls, overlooked opportunities, inadequacy,
urgency, potential threat, and to provide viable solution to the President
and Executive Committees.
3.3.2.3. In conjunction with Executive Committee
Directors, initiates draft policies, actions plans, and assists in preparing
statements, executive orders, and press releases on the President and/or SRP-USA/Canada's
behalf.
ITEM 3.4.
EXECUTIVE COMMITTEES
The regular
full session of the Executive Committee consists of 7 (seven)
Committees in
charge of administration, membership, news and information, policies and
procedures, public relations, special events, and treasury.
3.4.1. Definition
3.4.1.1. Each Executive Committee Director is a nominated
cabinet member of SRP-USA/Canada who interacts directly with the
President. A Committee Director may recruit qualified SRP-USA/Canada
members to form working subcommittees to alleviate the workload warranted.
Each Committee Director candidate, whose election is held in concurrence
with the presidential election, may seek the office of directorship for a
maximum of 2 (two) Committees.
3.4.1.2. Changes in the number of the Committees or the
extent of assignments may be warranted in accordance to the overall scope of
the SRP-USA/Canada operation.
3.4.2. General
Responsibility
The general scope of
responsibilities of each Committee is interacting with the State/Province
Delegate, the President, the supporting public, and each other to ensure
proper implementation of action plans, policies, approved drafts so as to
carry them into the fullest effects. In addition to the individually
prescribed tasks, each Committee is charged with but not necessarily
confined to the following:
3.4.2.1. Nominating Committee's structure and members
shall be first order of business with the presidential confirmation to
recognize its full merit.
3.4.2.2. Submit budget to the President and Treasurer,
outlining all fixed and recurring costs plus any potential revenue as the
calendar action plans are put into implementation
3.4.2.3. The Director may interact directly with another
Committee Director, through the Secretary General, or the Director of
Administration to share issue of concern, best business practices, or
available resources in alleviating any common or unique task or project.
3.4.2. 4. Review and approve all reimbursable and pending
expenses relating to the operational costs of the Committee and submit the
Expense Reimbursement Form with all receipts to the Treasurer for
reimbursement. None-receipt purchase shall be justifiable should it be
substantiated as mission related, otherwise the spending party will incur
all the expenses.
3.4.2.5. Each Committee may seek guidance from the
Policies and Procedures Committee drafting its operating instructions, rules
and regulations, but must obtain Committee's own simple majority vote for
adoptions.
3.4.3.
Administrative Committee
Objective: To bring about
assistance and intermediary role between different Executive Committees.
3.4.3.1. Arrange and coordinate formal and informal
meeting/conference schedule at the SRP-USA/Canada level to include those
between SRP-USA/Canada and other SRP chapter. However, the initial decision
to hold a meeting is not solely from the director or his/her Committee;
other SRP-USA/Canada chapter including the President may call upon a meeting
as deemed necessary.
3.4.3.2. Once the general consent to meet is agreed upon,
the Committee shall solicit prioritized subject item to form agenda starting
from the initiating party and finalize it with the President's
concurrence.
3.4.3.3. Depending on the urgency of the circumstances,
invite relevant participants to scheduled meetings through anyway possible
(mail, e-mail, fax).
3.4.3.4. Oversee general publication and identify any
required modifications of standardized forms, stationary, and award
trophy/certificate.
3.4.3.5. Except for financial record and press
publications, file all records and reports including survey report, meeting
agenda/minute, used form/stationary, corresponding letter, and press release
utilized in any given transaction by SRP-USA/Canada.
3.4.4.
Membership Committee
Objective: To
provide recruiting and retaining activities oversight, plant grassroots
support, generalize SRP membership, and enforce membership rules as to
cultivate the predominance of a law-binding network.
3.4.4.1. Initiate or modify an existing recruitment plan
with the suggestions of local affiliate offices (city level) to allocate
resources (campaign material, funding support,...etc), and focused
intensity.
3.4.4.2. Strengthen existing recruiting network through
regular communication and logistic support, and advance to new ones by the
instrument of the old networks should that be necessary.
3.4.4.3. An organization thrives mainly on its reputation,
as is the rule of law to which SRP-USA/Canada is bound. The Committee shall
be the vanguard against theft, fraud, abuse of membership rights and
privileges, and any failures to abide by membership obligations.
3.4.4.4. To bring about a system of reward and punishment
namely recognize those who produce positive results and punish those who
deliberately bring harm to the organization from the standpoint of
membership benefits.
3.4.4.5. The Committee shall cooperate with SRP-USA/Canada
local leaders to establish structure and organization at the local level.
3.4.4.6. Work with SRP-USA/Canada local leaders
establishing plans for growth as to offer incentives for outstanding
recruiting performance, and a sense of mutual belonging to the new recruit
and to challenge their productive potential, all of which are the
cornerstones of bonding a dynamic and robust symbiotic relationship.
3.4.4.7. Provide local leadership role, and maintain
complete and accurate record of membership registry. This may require
cross-reference from the registry maintained by the Administrative
Committee.
3.4.4.8. The local leaders at the informing of respective
treasurer and/or the Committee functionaries shall enforce strict adherence
to membership obligations.
3.4.4.9. Generate tri-monthly membership report to the
Director of Administration to update and amend membership information (i.e.
success stories, recruitment abnormalities, trial incentives, and membership
loss/gain) to the membership registry database. The Director of
Administration shall in turn submit one report to the President every
synchronized interval.
3.4.4.10. In coordination with the Director of Public
Relation and local leaders facilitate the dissemination of leaflets,
campaign literature in a fashion mandated by the Public Relations Committee.
3.4.5. Treasury
Committee
Objective:
The Treasury Committee, through its Director and it appointed members
performs any and all tasks of financial bearing, whose variety encompassing
but not limited to management of SRP-USA/Canada's budget, accurate and
complete financial records keeping, and balancing the budget for the SRP-USA/Canada.
3.4.5.1. While the Committee's Director is elected from
among State/Province Delegate members; its Director, the President and one
of his/her Vice-Presidents decide the composition as a minimum.
3.4.5.2. Co-signing expended or allocated bills as
finalized by the President, and monitoring/analyzing budget profiles of both
fixed and revolving accounts to assess certain suitable budget balancing
actions prior to an approval proceeding.
3.4.5.3. Reimburse the properly
approved expenses with a receipt.
3.4.5.4.
Maintain accurate and complete financial records and financial
activities
including related forecasts.
3.4.5.5. Submit as-needed periodic Revenue & Expense
report to the President, State/Province Delegate, and contributing members.
3.4.5.6. Proactively initiate fundraising ideas, identify
funding sources, and promote activities of financial gain for the party's
coffer.
3.4.5.7.
Secure the receipt of approved wire transfers to SRP-Cambodia
with at least
knowledge of a legitimate third party (e.g. an SRP-USA/Canada member).
3.4.5.8. Arbitrarily assist a program organizer (i.e.
person charged with providing relief to distraught farmers/victim of land
confiscation) facilitating transient relief account for special needs,
whenever possible through stepped-up efforts in internal advertising or a
public fundraising function.
3.4.6.
Policy & Procedure Committee
Objective: To
draft, amend, and interpret any SRP-USA/Canada or its Committee's policies,
rules and regulations, guidelines, procedures, and protocols,
institutionalizing common cognitive empiricism, modern management practices
and the basic tenets of democracy for the purpose of establishing orderly,
consistent, impartial, and effectual SRP-USA functional realm.
3.4.6.1. Initiate draft or outline SRP-USA/Canada and
Committee-level policies, rules and regulations per coordination with other
Committees, the President and the Vice Presidents, to be followed by

3.4.6.2.
Interpret policy, rule and regulation, guideline, or procedure
that contains ambiguity, or discrepancy in a ruling article.
3.4.6.3. Lay out enforcement hierarchy (chain of
authority) with a proportion of check and balance ensuring enforcement and
due process are exercised at all level.
3.4.6.4. Ensure all draft policies, rules and regulations
are of objective intent within the realm of practical norms,
non-contradictory, and subject to least interpretations.
3.4.6.5. Recommend obsolete documents be suspended,
rescinded, and/or revised with the President and Vice Presidents
deliberation prior to subjecting to State/Province Delegate legislative
process.
3.4.6.6. Drafting guideline, process or protocol relevant
to a particular Committee may seek the Policies and Procedures Committee's
discretion but the Committee may also opt to undertake the task singularly
without external collaboration.
3.4.7.
News & Information Committee
Objective:
Objectively disseminating any hard copied, internet-borne media material or
periodicals of significant ramifications to SRP or Cambodia's vital
interest. Proactively promoting the freedom of press of any form (printing,
broadcasting, webmedia) when they would purposely serve to convey factual
and objective news and information contributing to freedom, democracy and
the rule of law.
3.4.7.1. Propose a calendar actions plan to include
news-publishing means, distribution details, labor and material, and
associated budget. Successful lines of publications or information content
particularly those of self-sustaining quality should be kept for repeated
use. The president shall approve the actions plan prior to implementation.
3.4.7.2. In coordination with Director of
Membership and local-level leadership maintain and expand a network of an
interactive media-receiving beneficiary to keep costs at bare minimum while
effortlessly reaching wide audience.
3.4.7.3. The director shall be the first
line of advocacy instilling ethics and professionalism in any journalistic
works done by SRP-USA/Canada as to maintain original, accurate, impartial,
and non-partisan media coverage.
3.4.7.4. Deliver the weekly Light of the
Khmer Nation publication to the SRP-USA/Canada members by mail, facsimile,
e-mail, or Internet posting.
3.4.7.5. To the extent necessary, keep the
President and State/Province Delegate updated of the implemented and
unimplemented activities including any best and worse yield indications.
3.4.8.
Public Relations Committee
Objective:
1.To advocate the party's platform, missions, and achieved results, while
projecting their net positive images unto the public (i.e. Federal
Government, Media, and International Organizations, Donor Countries,…etc).
2.To safeguard the party's livelihood and protect its prospective
interests.
3.4.8.1. Take a proactive stance in influencing the
opinions of the US/Canadian government, the international community, and the
participating NGOs regarding to the Cambodian issues. The approaches are
commonly lodged in the forms not necessary limited to individual or
collectively signed letters, personal visit, and mass demonstration.
3.4.8.2. Keep calendar booking of the public function
events such as planned demonstration dates, meeting with
policy-maker/lobbyist, and addressing/participating in community cultural
and religious gathering,…etc. Play the leading role or a complimentary one
organizing such formal meetings between SRP officials, supporting community,
and public personalities.
3.4.8.3. Depending on the size, purpose, and constrains of
the given circumstances, organize mass demonstration that may involve
interstate and Canada participations. A typical demonstration gathering is
preferably spontaneous but efforts to induce a sizable turnout may involve a
series of tasks ranging from making point of contacts with
community/organization of interest, supplying needed items (poster, banner,
speakerphone...etc), to improvising transportation/room/board.
3.4.8.4. The Committee shall be the first line of sight,
enforcing the prohibition of sarcasm and contemptuous language from being
displayed in public on the Party's behalf.
3.4.8.5. The Committee is tasked to compose/review,
publish and distribute hard-copied SRP-USA/Canada literatures (i.e.
catalogue, leaflet, fact sheet, videotape, DVD, survey form,…etc), which
requires a minimum network of coordination with the Administrative
Committee, News and Information Committee, Membership Committee, and in
particular the local leadership tributary as the final outlet for
distribution.
3.4.8.6. In the event of a potentially explosive
controversy due to source externally or internally (allegation of wrong
doing, death of an SRP-member, member defections,…etc), an appropriate
measure should be sought from the Litigation Council with the President's
consultation, and cautiously proceed to implementing the appropriate remedy
(i.e. forum discussion, public manifesto, or disclaimer, ...etc).
3.4.9.
Fundraising Committee
Objective:
Other than membership collection activities, raise fund from an organized
event, as well as random or targeted solicitations for a specified purpose.
3.4.9.1. Identify the most viable fundraising options
suitable to fulfill a specified purpose. Depending on the intended use,
fundraising should not be limited to any one method: Formal banquet,
cultural or religious ceremonies, direct mailing, sale/auction, or general
announcement are the more feasible fundraising avenues. Likely sources could
be inside or outside SRP supporting community, charitable foundations,
businesses, government and non-government based institutions.
3.4.9.2. Return tangible incentives and/or results to
donor/sponsor so as to justify their contribution. These incentives range
from memorabilia, T-shirt, or simply showing proof of documented
accomplishments from past contributions, to Certificate of Appreciation.
3.4.9.3. Whenever possible engage local leadership to
maximize resources and collaboration between participating entities in a
fundraising effort.
3.4.9.4. Keep accurate booking of all transactions,
including projected forecasts as the roadmap to plan future fundraising
activities.
3.4.10.
Special Events Committee
Objective: To
identify the circumstance of a function other than fundraising event and
regular meeting, thereby collecting fund, labor/material to induce the
highest possible participation.
3.4.10.1. Draw up plans for pre-scheduled and spontaneous
events, and reserve for any foreseeable needs preferably well ahead of the
anticipated events.
3.4.10.2. Book and arrange special events such as US tours
for SRP dignitaries/distinguish guests, not exclusive of recreational
gatherings, religious ceremonies, and publicity activities.
3.4.10.3. Secure cooperation from all levels of benefactors
and participants as in the case of a US/Canada tour by SRP dignitary,
communication is channeled from a tour scheduler in Cambodia down to local
affiliate office to sort out the sequence and number of visits, arrange
flight schedule, accommodate food/housing, and plan out intended agenda.
3.4.10.4. Maintain and update for future use a registry of
used and perennial resources to contain complete people's contact
information (for tour, flight, correspondence), logging contacts, place/item
reservations, rental and lease agreement, promotional
discount,...etc.
SECT. 4.
LITIGATION COUNCIL
Objective:
Has the dual capacities of an investigating body and a jury whose
independent ruling carries exclusively on internal SRP-USA/Canada disputes.
ITEM 4.1. COMPOSITION & SPECIAL DELEGATION
4.1.1. A minimum of 3 (three) but not to exceed 7
(seven) standing members shall compose the Committee at any one term.
Eligibility considerations are given to any third party SRP-USA/Canada
member whose membership is confirmed by State/Province Delegate majority
vote.
Committees
that compose of 3 to 5 members shall rule with a unanimity; the other two
compositions are required to reach a verdict with at lease 5 votes,
otherwise hung jury will result followed by another deliberation. One or
more members shall be added by presidential appointment to the Committee
following a second hung jury.
4.1.2. All activities undertaken by the Committee shall
have complete independence and immune from influence of the executive
elements including the Office of the President. Should there be reasonable
doubt of interference, the President or the non-dispute person next in chain
of authority (higher or lower) shall order a complete overhaul of the
activity.
4.1.3. In the event a member is a defendant, plaintiff
or an accessory to a case, his/her membership shall be forfeited and
presidential appointment shall determine his/her replacement. If the
President is a disputing party, the next person in the chain of authority
(higher or lower) namely the First Vice-President shall appoint the
substitute and the additional members.
ITEM 4.2. RESPONSIBILITY
4.2.1. The Committee shall take the mediating role if
every disputing party is a group (i.e. city level SRP-USA/Canada affiliate),
in resolving a case by seeking a common ground agreeable to all disputing
parties, otherwise the Committee shall render a verdict and issue a sentence
at its discretion in accordance to the admitted prima-facie evidence
together with the provisions of the law.
4.2.2. The Committee's Chairperson, elected from among
appointed members, shall oversee and reinforce proper conducts on all
activities including Committee's own investigations, gathering and
determining the admissibility of evidence.
4.2.3. Unless otherwise pronounced improper, bearing of
reasonable doubt of interference or misconduct, all decisions/rulings are
final and not open for further appeal. The appellant (s) is then referred to
a higher decision-making body such as SRP's Steering Committee or the
equivalent thereof.
CHAPTER V.
VOTING PROCEDURE
SECT 1. Having its members drafted from a diverse pool of
highly qualified members, the formation of an elections Committee shall take
place at least two (2) months ahead of the election. This Committee shall
establish guidelines and voting procedures within allowable parameters, as
well as monitor and enforce them during the course of an election. Refer to
Election Procedures and Regulations for unabridged details.
SECT. 2. Elections may take place on a date and location as
deemed appropriate by the Elections Committee.
SECT. 3. Candidate nomination may be solicited by regular
mail or electronics means, and qualifications shall accord to those outlined
in the Elections Procedures and Regulations.
SECT. 4. Through verifiable information such as name,
State/Province Delegate Registration Number, and/or SRP membership number,
absentee voting may be done electronically or by mailing.
SECT. 5. A proxy vote is acceptable in all situations
provided eligibility is verifiable as stated above.
SECT. 6. A tie vote shall be overridden by the Supreme
State/Province Delegate’s general consensus.
SECT. 7. A
simple majority vote is adopted in all situations unless otherwise
specified.
CHAPTER VI.
AMENDMENT
AND RATIFICATION
SECT. 1. State/Province Delegate ’s vote shall adopt amended
section or item to which any portion of this Charter is repealed, modified,
or added, and shall ratify immediately thereafter by the signatures of its
holding members.
SECT. 2.
Amendment shall be inscribed in this document under the Amendment Section.
SECT. 3.
The present Charter shall be presented in both English and Khmer languages.
SECT.
4. The signatures of the original State/Province Delegate
members shall therefore ratify the first version of SPR-USA/Canada Charter.
