THE SRP-USA/CANADA ELECTION COMMITTEE PROCEDURES

Declaration:
Candidates must obtain from, and submit an application with a one [1] page
of a biographical statement; two [2] pages of principles and issues for
which the candidates stand for. In addition, the candidates must submit a
copy of a verification of enrollment with SRP-USA/Canada such as a copy of a
photo membership card to the SRP-USA/Canada Election Committee Executive
Office prior to having the candidates’ names placed on the ballot.
Candidates must also file a Declaration of Candidacy made and subscribed to
under oath and shall state that the person filing the Declaration is
announcing his candidacy for the office stated therein, that he/she is
eligible for said office, sex, gender, age, marital status, place and date
of birth, his national-citizenship, whether natural- born or naturalized;
the registered political party to which he/she belongs; if married, the full
name of the spouse; his legal residence, giving the exact address, his
profession or occupation or employment; that he/she will support and defend
the Constitution and Bylaws of the SRP-USA/Canada and will maintain true
faith and allegiance thereto; that he will obey the laws, orders, decrees,
resolution, rules and regulations promulgated and that the facts stated in
the certificate are true and correct of his own personal knowledge.
CANDIDATE QUALIFICATIONS AND RELATED
MATTERS:
All candidates must agree to abide by the
SRP-USA/Canada Election Committee rules to become eligible to be on the
election ballot. The SRP-USA/Canada Election Committee shall place on the
ballot the name and position sought of any and/or all properly declared
candidates who meet the filing deadline. A declaration of candidacy requires
filing and submits to the SRP-USA/Canada Election Committee Executive Office
at 7157 Ridge Glen Ct. Jacksonville, Florida, 32216.
A qualified candidate may withdraw his/her candidacy at any time by sending
a written statement by certified mail-return receipt request to the SRP-USA/Canada
Election Committee before the unofficial results are posted by the SRP
USA-Canada Election Committee on Election Day.
ELECTION PROCEDURES:
The candidates polling more than 50% of the overall vote in the SRP-USA/Canada
Election shall be declared as the elected President of the SRP-USA/Canada
for the term of 2009-2010. The candidates polling less than 50% of the vote
in the SRP-USA/Canada Election shall NOT be elected as the
President of SRP-USA/Canada for the term of 2009-2010. If the candidates
polling are tied at 50%, the SRP-USA/Canada Election Committee shall hold an
executive meeting and review all relevant information. The SRP-USA/Canada
Election Committee shall release a final written decision within one[1] week
to candidates and the general members by e-mail and/or post it on SRP-USA/Canada
website as to who shall be the elected President of SRP- USA/Canada for the
term of 2009-2010. In order to arbitrate the verdict, the SRP USA/Canada
Election Committee shall refer to the
SRP-USA/Canada Constitution and Bylaws Section 3.1.1 and
sub-section 3.1.1.1-3.1.1.4, Section 3.1.2 and sub-section 3.1.2.1-3.1.2.5,
and/or [if needed to] insert additional recourses to determine the
elected President of SRP-USA/Canada for the term of 2009-2010.
Candidates:
- All candidates must sign a
Declaration of Candidacy form PRIOR to submitting
their
application of candidacy;
- All candidates shall qualify according to, and
subscribing in the
SRP-USA/Canada Constitution and Bylaws, Section 3.1.1 and
Sub-Section 3.1.1.1-3.1.1.4;
- All candidates must be file and submit all
required documents and forms including
biography form at least two [2] weeks PRIOR to October 16,
2008 to the SRP-USA/Canada Election Committee’s Executive
Office.
- The candidates must send all required documents
and/or forms in a closed/sealed envelop by certified mail-return receipt
request to the SRP-USA/Canada Election Committee Executive Office at
7157 Ridge glen Ct. Jacksonville, Florida, 32216, before the
deadline set forth by the SRP-USA/Canada Election Committee on
October 16, 2008 by 5:00 pm EST.; (No Application will be accepted after
October 16, 2008)
- Each candidate shall be personally responsible for
the entirety of his/her campaign and all deadlines set forth in the
election packet;
- No candidate shall be allowed to run for the
SRP-USA/Canada office of Presidency if he/she is NOT a
member of SRP-USA/Canada.
- No candidate shall be allowed to run for the SRP-USA/Canada
office of Presidency if he/she opposes and/or NOT upholds
the principles and issues that carried out in the best interests of the
people and nation of Cambodia;
- A candidate wishing to withdraw their
Declaration of Candidacy may do so at any time in writing, by
submitting it to the SRP-USA/Canada Election Committee Chairman, Mr.
Seng Hor. This may include an e-mail, to the SRP-USA/Canada Election
Committee Chairman at
mrshor@comcast.net. After a withdrawal has been received by the SRP-USA/Canada
Election Committee Chairman, the candidate may not be reinstated;
After the filing deadline, if there are NO qualified
candidates for the SRP-USA/Canada Presidency, the SRP-USA/Canada Election
Committee shall reserve the right to reinstate, and extend the duties and
responsibilities of Mr. Kimly Chea for the next mandated terms.
Campaign Rules:
General:
- Campaigning shall be restricted to the SRP-USA/Canada
grounds and by emails and/or off emails. Campaigning overseas is
prohibited;
- Establishing a campaign platform;
- The preparation of campaign materials;
- Arranging campaign strategy;
Publicity:
- Specified campaign materials can be displayed
starting the Monday, October 3, 2008 at 7:00 a.m. A
candidate may distribute materials to the SRP-USA/Canada general members
by emails and/or mails prior to the election. Any public display of such
material prior to the above stated time is prohibited. (Materials shall
include one [1] page of biographical statement, backgrounds and two [2]
pages of principles and issues for which the candidates stand for, and a
copy of a photo membership card.)
- Any unusual devices employed for campaigning must
be declared in writing by the candidate and approved writing by the SRP-USA/Canada
Election Committee PRIOR to usage.
- The SRP USA-Canada Election committee members shall not be allowed to
wear campaign materials or endorse any candidate while on the job.
- The official receiving the ballots will ensure
that the ballots received are secured in a locked location until they
are counted on the final day of the election. All ballots must be
recorded; kept and maintained on files at, and by the SRP-USA/Canada
Election Committee in order to ensure that all ballots are counted on
the final day of election.
- The SRP-USA/Canada Election Committee will
announce the election results on November, 2008 to the
candidates and general members through email, press release, and SRP-USA/Canada
web site.
- Candidates may request a recount, after the
declaration of the results, by petition to the SRP-USA/Canada Election
Committee within two [2] consecutive days after the announcement of the
election results and the SRP-USA/Canada Election Committee shall order a
recount upon its own motion. In the event that results are confirmed by
3 out of 5 counts conducted then no further recounts may be requested.
Campaign Spending:
- The candidates shall responsible for their own
expenditures for their campaigning materials.
General Election:
- The names of the two candidates on the ballot
receiving the greatest number of votes shall be placed on the final
ballot. In any regular Final Election and any special election (referred
to the SRP-USA/Canada National Council the final verdict to determine
the elected President of the SRP- USA/Canada), the candidate who has the
greatest number of votes shall be declared as the President of the SRP-USA/Canada.
Ballots:
- Announcing Candidates to be placed on a ballot on
October 21, 2008.
- The names of all candidates for the office shall
be placed on the ballot. All names on the ballot will be full legal,
given names. Placement of names shall be determined by random selection.
All unopposed candidates will be last on the ballot.
- Ballots will be accessed via election website.
- SRP-USA/Canada Presidential campaign shall
start…from the time in which Candidates have submitted their
completed required materials to the SRP-USA/Canada Election Committee’s
Executive Office, and end on October 24, 2008.
- Mailing ballots to eligible voters on
October 29, 2008
- (All ballots must receive by the SRP-USA/Canada
Election Committee no later than November 8, 2008 by 5:00pm EST.)
- Ballots close on November
10, 2008 at 5:00pm EST.
Voting:
- SRP-USA/Canada National Council members and
State/Provincial committees cast their votes
Counting Votes:
- Votes shall be counted immediately following the
closing of the polls, no later than 24 hours after the final closing of
the polls. No ballots will be accepted after the published time of
closing. The announcement of the election result shall be announced on
November 17, 2008.
GRIEVANCES, COMPLAINTS, AND VIOLATIONS:
Grievances and complaints are written to reflect the rules of the SRP-USA/Canada
Election Committee and the following rules shall govern the filing and
processing of grievances regarding Election. For purposes of this
section, “grievance” and “complaint” shall assume the same meaning.
Filing of grievances
The candidate must send a written grievance letter with a bullet points
describing issues and/or concerns is sent to the SRP USA/Canada Election
Committee. Make sure the grievance letter with bullet points describing
the issues and/or concerns is sent to the SRP USA/Canada Election
Committee no later than 10 days from November 10, 2008 or it may be
disregarded. Make sure that when you send it in it is sent and addressed
directly to the Chairman of the SRP USA/Canada Election Committee.
Review of grievances
After the grievance has been filed, The SRP-USA/Canada Election Committee
shall collect any and all relevant information. Within three [3] days, the
SRP-USA/Canada Election Committee shall hold an executive meeting. The SRP-USA/Canada
Election Committee will review the available materials. After a preliminary
review of the grievance and/or the SRP-USA/Canada Election Committee may
allow the candidates making the grievance to present their case. The SRP-USA/Canada
Election Committee shall send a result of a preliminary review and
memorandum of a review to the candidates.
The SRP-USA/Canada Election Committee shall release a final decision to the
candidates and general members thereafter. The SRP-USA/Canada Election
Committee shall issue its written decision to candidates and the general
members by email and/or post it on SRP-USA/Canada Web Site.:
